Businessman Nyerere faces murder charges

A businessman, Makongoro Joseph Nyerere, appeared before the Kisutu Resident Magistrate’s Court in Dar es Salaam, charged with murder. He is accused of killing an entrepreneur, Onesphory Kituly, in 2011.
The accused is the son of Joseph Nyerere, a brother to the Father of the Nation, Mwalimu Julius Nyerere. He was joined in the case that also involves another prominent businessman, Marijani Abubakar, alias Papaa Msofe, who appeared before the same court, for the first time, in connection with the same charge on August 10, last year.
Before Resident Magistrate Agnes Mchome, the accused was not allowed to enter any plea to the charge, as the lower court has no jurisdiction to entertain murder offences. Murder, among capital offences, is only tried by the High Court. Nyerere was remanded in custody until February 20, when the case will be mentioned.

Bail was not granted because whoever is charged with murder, according to the law, is not entitled to be provisionally released. Investigations into the case, according to State Attorney Charles Anindo, have not been completed.

Prosecuting, the state attorney alleged that the accused committed the offence on November 6, 2011, at Magomeni Mapipa in Kinondoni District in the city. It is alleged that Msofe and the deceased had been at loggerheads for a long time over a piece of land. Their dispute has allegedly been pending since 2007.
