Those alleged victims are two men, both over the age of 60, who are mentally and physically disabled.
Mbugua worked overnights in the Haverhill group home where they live.
“He was punched in the face, and my brother is mentally incapacitated,” saidPatricia Ward outside the courthouse.
Maryann Lawler described the abuse she said her brother suffered at the hands of Mbugua.
“He pushed him in a wheelchair (into a) closed door several times and then repeatedly punched him on the ankle,” said Lawler. “He has a broken tibia and a bruise the size of a baseball on his ankle.”
Mbugua, a 22-year-old from Lawrence, has worked at the home for about six months.
The director of Fidelity House tells WCVB a Criminal Offender Record Information check was performed when he was hired. It may have only revealed criminal convictions.
But Team 5 Investigates discovered Mbugua was arrested on suspicion of disorderly conduct and threatening to rape a nurse at Lawrence General Hospital in March 2013.
The case was continued without a finding, and he was sentenced to probation.
There is now a warrant out for his arrest for violating that probation.
In April, Mbugua was arrested on suspicion of gross and open lewdness when he was accused of exposing himself on a city bus in Lawrence.
Both times he was allegedly drunk, police said. Haverhill police say Mbugua was intoxicated when he was arrested at the group home on April 25.
“I just can’t believe this,” Ward said. “It’s disastrous.”
Mbugua is due in Newburyport district court on May 19.
Both of his alleged victims plan on attending the dangerousness hearing.
